These General Terms and Conditions of Sale (hereinafter “GTC”) are intended to define the rights and obligations of the parties in the context of the sale of wellness products offered by the company OYABI KAMA \u2014 OK\u00c2 SARL, a limited liability company under Ivorian law, whose registered office is located in Abidjan (Ivory Coast), via its website as well as any other marketing channel.<\/p>

Any order implies full, complete and unreserved acceptance of these Terms and Conditions by the customer, who acknowledges having read them prior to validating their order.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

These General Terms and Conditions apply to all sales made by OYABI KAMA to customers located in Ivory Coast, in the OHADA area, within the European Union and, more broadly, internationally.<\/p>

It is expressly agreed that Ivorian law constitutes the applicable contractual basis. However, when the client qualifies as a consumer under European law, the mandatory consumer protection provisions of the law of their country of residence shall apply.<\/p>

\u00a0<\/em><\/strong>The customer declares to be at least 18 years old, or, if a minor, to place the order under the supervision and with the authorization of their legal representative.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

ARTICLE 3 \u2014 PRODUCTS AND REGULATORY STATUS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

The products marketed by OYABI KAMA are wellness products, including essential oil synergies, massage oils, scented mists and olfactory compositions.<\/p>

These products are developed in accordance with the principles of traditional and modern aromatherapy and are part of a holistic wellness approach, including physical, emotional and sensory dimensions.<\/p>

It is expressly stated that the products offered do not constitute medicines, medical devices or therapeutic treatments in any way.<\/p>

Certain products (massage oils, skin mists, and topical formulations) fall under the definition of cosmetic products as defined by Regulation (EC) No 1223\/2009 when marketed to customers in the European Union. For these products and markets, OYABI KAMA undertakes to designate a Responsible Person established in the European Union, to compile the corresponding Product Information File, and to submit the required notifications (CPNP portal) before placing them on the European market. The labeling of these products includes the mandatory information required by this regulation (list of ingredients, precautions for use, and contact details of the Responsible Person).<\/p>

The information, descriptions and usage advice provided on the website or in commercial materials are for informational purposes only and should not be considered a substitute for medical advice.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

In accordance with the provisions of OHADA law and, where applicable, European Directive 2011\/83\/EU on consumer rights, the customer acknowledges having received, prior to the conclusion of the contract, clear and understandable information relating in particular to:<\/p>

  • Their price,<\/li>
  • Payment terms,<\/li>
  • Delivery conditions,<\/li>

    Product prices are indicated in CFA francs (FCFA), including all taxes or excluding taxes depending on the delivery zone.<\/p>

    Conversions to euros (EUR) or dollars (USD) may be offered for informational purposes only.<\/p>

    Delivery costs, as well as any customs duties, import taxes or administrative fees required by the authorities of the destination country, are the sole responsibility of the customer.<\/p>

    OYABI KAMA reserves the right to change its prices at any time, it being understood that the applicable price is the one in effect at the time of order validation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    The order is considered firm and final once it has been validated by the customer and payment has been received.<\/p>

    OYABI KAMA reserves the right to refuse or cancel any order in the event of:<\/p>

    • Suspicion of fraud,<\/li>
    • Previous dispute with the client,<\/li>

      Payment is due in full at the time of ordering.<\/p>

      Accepted payment methods include secure online payment, bank transfer and mobile payment solutions, depending on the geographical area.<\/p>

      OYABI KAMA implements the necessary means to ensure the security of transactions, relying on service providers that comply with international security standards (including PCI-DSS).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

      Deliveries can be made to Ivory Coast, Africa, Europe and internationally.<\/p>

      Delivery times are provided for informational purposes only and do not constitute a firm contractual commitment.<\/p>

      It is expressly agreed that OYABI KAMA cannot be held responsible for delays attributable to carriers, customs formalities, force majeure events or any cause beyond its control.<\/p>

      The transfer of risk occurs at the time the products are handed over to the carrier.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

      The customer is solely responsible for paying any customs duties, import taxes or any other charges required by the authorities of the destination country.<\/p>

      OYABI KAMA cannot be held responsible for any blockage or delay related to these formalities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

      ARTICLE 10 \u2014 RIGHT OF WITHDRAWAL<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

      In accordance with the provisions applicable to consumers, particularly within the European Union, the customer has a period of fourteen (14) days from receipt of the product to exercise his right of withdrawal.<\/p>

      This right can only be exercised for unopened, unused products returned in their original packaging.<\/p>

      In accordance with applicable hygiene and wellness product regulations, any opened product cannot be returned or refunded.<\/p>

      To exercise their right of withdrawal, the customer must notify their decision by an unambiguous statement (email to [address to be specified] or any other means). They may use the model form below for this purpose:<\/p>
